Health and Safety at Work Act 2015 - Supporting regulations exposure draft released - Extra duties

New draft regulations that will support the newly named Health and Safety at Work Act (once it passed) have been released for further consultation. To see the regulations and how you can consult click on ths link: exposure-drafts-of-phase-one-regulations.pdf (249019). These regulations apply additional duties which businesses must comply with. Failure to meet these duties results in financial penalties being applied.

For example:

  Duty to maintain control measures

A PCBU who implements a control measure to eliminate or minimise risks to health and safety must ensure that the control measure is effective, and is maintained so that it remains effective, including by ensuring that the control measure is and continues to be— (a) fit for purpose; and (b) suitable for the nature and duration of the work; and (c) installed, set up, and used correctly.

Failure to do this could result in and instant penalty to an individual and PCBU. The amounts have not been set but they are indicating $3,000 for and individual and $10,000 or so for a PCBU.
